My wife and are both U.S. citizens. We live in the U.S. My wife has a kidney disease, so her doctor said it was not safe for her to have a baby. She is still fertile. We are exploring the option of coming to India to have our child through an Indian surrogate. We would use my sperm and my wife’s eggs, so our baby is 100% genetically ours. The U.S. Embassy in India requires a DNA testing to prove the baby is ours before they will issue a U.S. Passport. We also have to show all documents and contract agreemsnts. What are the Indian laws regarding this process? Will only my wife’s name and my name appear on the birth certificate?

I would recommend that you take up the Legal Audit and Risk Assessment Program in order to ascertain the legal issues in taking up surrogacy in India. This would help you understand the possible complications you may face in taking the surrogacy arrangement. It would provide you with legal opinion whether to take up surrogacy in India or not.

Sir,
case: A man donates his egg to a couple as the couple could not have a child. After the child was born, the biological father wants the baby back on the ground that he is the biological father of the child whereas the couple refuses to return the child back.
Kindly clarify whether this will fall within the ambit of surrogacy and what are the rights of both the parties.

We are mental health professional couple from south India. We underwent surrogacy as I was unable to conceive with treatment. The terms and conditions mentioned in the agreement were very clear. but we noticed that in the contract no mention was made regarding the issuance of birth certificate ,i.e they do not intend to give us birth certificate in our names or have legal mechanism in place so that local municipal corporation can issue the same. in this situation what should we do?
